Right of withdrawal & withdrawal form

Consumers have a right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.

A. Information on the right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

For contracts for the delivery of goods, the withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the last goods.

For contracts for the supply of data that is not on a physical data carrier and is produced and supplied in digital form (digital content), the withdrawal period is fourteen days from the day the contract was concluded.

To exercise your right of withdrawal, you must inform us (Tukluk GmbH, Bendlgasse 2/15, 1120 Vienna, Austria, phone: +43 699 194 788 22, email: info@tukluk.eu) of your decision to withdraw from this contract by means of a clear statement (by post or, preferably, by email). You may use the attached model withdrawal form, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days of the day on which we received your notice of withdrawal. We will make this reimbursement using the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

For contracts for the delivery of goods, we may withhold reimbursement until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is earlier.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract.

The deadline is met if you send the goods before the fourteen-day period has expired.

You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to examine their nature, characteristics and functioning.

Exclusion or early expiry of the right of withdrawal

For contracts for the supply of digital content, the right of withdrawal expires early if we have begun performing the contract after you have expressly agreed that we may begin before the end of the withdrawal period, you have confirmed that you are aware that you lose your right of withdrawal once performance begins, and we have provided you with a confirmation of the contract on a durable medium that sets out its content, including the aforementioned conditions for the early expiry of the right of withdrawal.

General information on returning goods

1) Please avoid damaging or soiling the goods. If possible, return the goods to us in their original packaging with all accessories and packaging components. Use protective outer packaging if necessary. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against damage in transit.

2) Please do not send the goods back to us carriage forward (unpaid).

3) Please note that points 1–2 above are not a condition for the effective exercise of the right of withdrawal.
